The Air Traffic Services (Exemption) Order 2001

Coming into force

The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred upon him by section 4 of the Transport Act 20001 and having consulted the Civil Aviation Authority in accordance with section 103(7) of that Act, hereby makes the following Order:

Citation and commencement1

This Order may be cited as the Air Traffic Services (Exemption) Order 2001 and shall come into force on 1 April 2001.

Interpretation2

In this Order—

  • “aerodrome traffic zone” means the airspace specified below—

    1. a

      in relation to an aerodrome other than one which is on an offshore installation;

      1. i

        at which the length of the longest runway is 1,850 metres or less;

        1. aa

          subject to sub-paragraph (bb), the airspace extending from the surface to a height of 2,000 feet above the level of the aerodrome within the area bounded by a circle centred on the mid-point of the longest runway and having a radius of 2 nautical miles;

        2. bb

          where the application of sub-paragraph (aa) would produce an aerodrome traffic zone that extends less than 1½ nautical miles beyond the end of any runway at the aerodrome, sub-paragraph (ii) shall apply as though the length of the longest runway is greater than 1,850 metres;

      2. ii

        at which the length of the longest runway is greater than 1,850 metres, the airspace extending from the surface to a height of 2,000 feet above the level of the aerodrome within the area bounded by a circle centred on the mid-point of the longest runway and having a radius of 2½ nautical miles;

    2. b

      in relation to an aerodrome which is on an offshore installation, the airspace extending from mean sea level to 2,000 feet above mean sea level and within 1½ nautical miles of the offshore installation;

  • “area control centre” means a centre established primarily for the purpose of providing an area control service;

  • “area control service” means the giving, in the interests of safety, of instructions, advice or information by means of radio signals to aircraft flying outside the vicinity of an aerodrome traffic zone.

Exemption authorising the provision of air traffic services3

The provision of air traffic services in respect of a managed area is authorised but this paragraph is subject to paragraph (2).

Paragraph (1) does not authorise the provision of an area control service from an area control centre or the provision of air traffic services by the holder of a licence granted under section 5 of the Transport Act 2000.

Duration of exemption4

The exemption granted by this Order shall continue in force for 10 years.

Section 3 of the Transport Act 2000 states that a person commits an offence if he provides air traffic services in respect of a managed area unless he is authorised to do so by an exemption granted under section 4 or by a licence granted under section 5.

Article 3 of this Order authorises the provision of air traffic services, other than area control and information services provided from an area control centre. The authorisation does not extend to services provided by the holder of a licence granted under section 5. The authorisation is to last for 10 years.
