SCHEDULE AMENDMENTS TO INSTRUMENTS

The GLA Roads Designation Order 2000

1.—(1) The GLA Roads Designation Order 2000(1) shall be amended in accordance with the following provisions of this paragraph.

(2) In paragraph 54 (designation of A312 as a GLA road) of the Schedule, after “with Western Avenue (A40)”, there shall be inserted “excluding the roundabout at the junction with the M4 Motorway”.

(3) In paragraph 55 (designation of A316 as a GLA road) of the Schedule, after “Chiswick Square” omit the words “excluding the roundabout at the junction with the M4 Motorway”.

The GLA Roads and Side Roads (Transfer of Property etc.) Order 2000

2.  In the GLA Roads and Side Roads (Transfer of Property etc.) Order 2000(2) (property transferred in relation to GLA roads and side roads) after article 5 there shall be inserted—

“Residential tenancies

5A.   Where any property transferred to Transport for London by or under articles 2 to 4 above from the Secretary of State as former highway authority was on the operative date subject to a residential tenancy, the interest of the landlord under that tenancy shall be treated for the purposes of paragraph 11 of Schedule 1 to the Housing Act 1988(3) (Crown tenancies entered into after commencement of Part I of that Act not to be assured tenancies) or of section 13 of the Rent Act 1977(4) (earlier Crown tenancies not to be protected tenancies) as if it belonged to the Secretary of State and not to Transport for London.”.
