The Secretary of State, being a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to measures relating to batteries and accumulators containing dangerous substances, in exercise of the powers conferred on him by that section and of all other powers enabling him in that behalf, hereby makes the following Regulations:—
1.—(1) These Regulations may be cited as the Batteries and Accumulators (Containing Dangerous Substances) (Amendment) Regulations 2001 and shall come into force on 31st August 2001.
(2) These Regulations extend to Great Britain.
2. The Batteries and Accumulators (Containing Dangerous Substances) Regulations 1994(3) are further amended in regulation 4 as follows:—
(a)in paragraph (1), the words “and subject to paragraph (3) below” are omitted; and
(b)the whole of paragraph (3) is omitted.

These Regulations correct a defect in regulation 4 of the Batteries and Accumulators (Containing Dangerous Substances) Regulations 1994 (S.I.1994/232, as substituted by regulation 2(f) of the Batteries and Accumulators (Containing Dangerous Substances) (Amendment) Regulations 2000 (S.I.2000/3097).
Regulation 2 of these Regulations omits the exception in regulation 4(3) to the requirement in regulation 4(1) that batteries and accumulators be marked in accordance with Commission Directive 93/86/EEC. That Directive no longer provides an exception for batteries and accumulators produced in or imported into the European Economic Area before it came into force.
This instrument is being issued free of charge to all known recipients of S.I.2000/3097.
