The Secretary of State, in exercise of the powers conferred upon her by sections 107, 112(1), 113 and 114 of the Scotland Act 1998(1) and of all other powers enabling her in that behalf, and being of the view that paragraph 24 of schedule 3 to the Regulation of Care (Scotland) Act 2001(2) is not, or may not be, within the legislative competence of the Scottish Parliament, hereby makes the following Order:
1. This Order may be cited as the Scotland Act 1998 (Regulation of Care (Scotland) Act 2001) Order 2001 and shall come into force on 3rd August 2001.
2. Paragraph 24 of schedule 3 to the Regulation of Care (Scotland) Act 2001 is hereby repealed.

This Order repeals paragraph 24 of schedule 3 to the Regulation of Care (Scotland) Act 2001 which, if brought into force, would make modifications to Schedules 14 and 15 to the Finance Act 2000 (c. 17) which make provision for two tax incentives: enterprise management incentives and the corporate venturing scheme respectively. Fiscal, economic and monetary policy (including, among other things, taxes and excise duties) is a reserved matter for the purposes of the Scotland Act 1998 (Section A1 of Part II of Schedule 5 to the 1998 Act).
