Whereas pursuant to paragraph 4(4) of Schedule 8 to the Terrorism Act 2000(1) (“the 2000 Act”) the Secretary of State has made an order(2) bringing the code of practice in connection with the audio recording of any interview by a constable at a police station of a person detained under Schedule 7 to or section 41 of the 2000 Act (“the audio code”) into operation on 19th February 2001;

Now, therefore, in exercise of the power conferred upon him by paragraph 3(1)(b) of Schedule 8 to the 2000 Act, the Secretary of State hereby makes the following Order:

1.  This Order may be cited as the Terrorism Act 2000 (Code of Practice on Audio Recording of Interviews) (No. 2) Order 2001 and shall come into force on 19th February 2001.

2.  Any interview by a constable of a person detained under Schedule 7 to or section 41 of the 2000 Act, where the interview takes place in a police station within the meaning of paragraph 1(2) of Schedule 8 to that Act, shall be audio recorded in accordance with the audio code.

Explanatory Note

(This note is not part of the Order)

This Order requires interviews of persons detained under Schedule 7 (Port and Border Controls) or section 41 (arrest without warrant of a person reasonably suspected of being a terrorist) of the Terrorism Act 2000, which are conducted by a constable at a police station, to be audio recorded in accordance with the code of practice made for the purpose. “Police station” includes any place which the Secretary of State has designated under paragraph 1(1) of Schedule 8 to the Terrorism Act 2000 as a place where a person may be detained under section 41 of that Act.
