The Secretary of State for Health, in exercise of the powers conferred upon him by sections 11(4)(a) and 126(3) and (4) of the National Health Service Act 1977(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement, interpretation and extent

1.—(1) This Order may be cited as the National Blood Authority (Establishment and Constitution) Amendment Order 2001 and shall come into force on 29th May 2001.

(2) In this Order—

“the Order” means the National Blood Authority (Establishment and Constitution) Order 1993(2).

(3) This Order extends to England and Wales.

Constitution of the Authority

2.  Article 4 of the Order is amended by substituting, in sub-paragraph (1)(b), for the words “five members” the words “six members” and, in sub-paragraph (1)(d), for the words “four members” the words “five members”.

Explanatory Note

(This note is not part of the Order)

This Order further amends the National Blood Authority (Establishment and Constitution) Order 1993. The Authority is a Special Health Authority established under section 11 of the National Health Service Act 1977.

In particular, this Order provides for an increase in the number of non-officer members of the Authority from five to six and in the number of officer members from four to five.

1977 c. 49; section 11 was amended by the Health Services Act 1980 (c. 53), Schedule 1, paragraph 31, by the National Health Service and Community Care Act 1990 (c. 19) (“the 1990 Act”), Schedule 10, by the Health Authorities Act 1995 (c. 17), (“the 1995 Act”), Schedule 1, paragraph 2 and by the Health Act 1999 (c. 8) (“the 1999 Act”) Schedule 4, paragraph 6; section 126(3) was amended by the 1990 Act, section 65(2) and by the 1995 Act, Schedule 1, paragraph 57; section 126(4) was amended by the 1990 Act, section 65(2) and by the 1999 Act, Schedule 4, paragraph 37(6). Functions exercisable in relation to a cross-border body which by their nature cannot specifically be exercised in relation to Wales are exercisable concurrently by the Secretary of State—see article 2(c) of the National Assembly for Wales (Transfer of Functions) Order 1999, S.I. 1999/672.
