Subject to paragraph (2), any equipment which—
a
bears the F1UK marking and the indication of the guaranteed sound power level in accordance with regulation 7(2)(c); and
b
is accompanied by F2a declaration of conformity in accordance with regulation 7(2)(d),
shall be taken to conform with all the provisions of these Regulations which apply to it, including the appropriate conformity assessment procedure specified in regulation 10, unless there are reasonable grounds for suspecting that it does not so conform.

Paragraph (1) does not apply in relation to an enforcement authority where a person fails or refuses to make available to the enforcement authority the documentation which he is required, by the conformity assessment procedure which applies to that equipment, to retain a copy thereof.

is accompanied by an EC declaration of conformity in accordance with regulation 7(2)(d),
shall be taken to conform with all the provisions of these Regulations which apply to it, including the appropriate conformity assessment procedure specified in regulation 10, unless there are reasonable grounds for suspecting that it does not so conform.
