In exercise of the powers conferred on the Secretary of State by section 58(3) of the Education Act 1997(1) the Secretary of State for Education and Employment hereby makes the following Order:
1. This Order may be cited as the Education Act 1997 (Commencement No. 4) Order 2001.
2. The following provisions of the Education Act 1997 shall come into force on 1st September 2001—
section 37(5)
section 57(1) and (4) to the extent that those subsections relate to the provisions of Schedules 7 and 8 specified below.
In Schedule 7, paragraph 30(b)
In Schedule 8 the repeal—
of sections 400 and 401 of the Education Act 1996, and
in section 408(4)(l) of that Act, of “, 400, 401”.

This Order brings provisions of the Education Act 1997 into force on 1st September 2001 which provide for the repeal of sections 400 and 401 of the Education Act 1996. Those sections provided for a system of approval of qualifications which is superseded by sections 96 and 97 of the Learning and Skills Act 2000. Section 96 of the Learning and Skills Act 2000 will come into force on 1st September 2001 (see the Learning and Skills Act 2000 (Commencement No. 3 and Savings and Transitional Provisions) Order 2001 (S.I. 2001/654) as to England and the Learning and Skills Act (Commencement No. 3 and Transitional Provisions) (Wales) Order 2001 (S.I. 2001/1274 (W. 73) (C. 46)) as to Wales).
By virtue of this and previous commencement orders all unrepealed provisions of the Education Act 1997 which are brought into force by commencement order will be in force on 1st September 2001.
