The Fees for Certificates of Arrest and Surrender of Deserters and Absentees (Army and Air Force) (Amendment) Regulations 2001

The Secretary of State, in exercise of the powers conferred on him by section 189 of the Army Act 1955(1) and section 189 of the Air Force Act 1955(2), hereby makes the following Regulations:—

1.  These Regulations may be cited as the Fees for Certificates of Arrest and Surrender of Deserters and Absentees (Army and Air Force) (Amendment) Regulations 2001 and shall come into force on 1st April 2001.

2.  In regulation 2 of the Fees for Certificates of Arrest and Surrender of Deserters and Absentees (Army) Regulations 1956(3) and the Fees for Certificates of Arrest and Surrender of Deserters and Absentees (Air Force) Regulations 1956(4), for the word “clerk”, where it first occurs, there shall be substituted the words “proper officer”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Fees for Certificates of Arrest and Surrender of Deserters and Absentees (Army) Regulations 1956 and the Fees for Certificates of Arrest and Surrender of Deserters and Absentees (Air Force) Regulations 1956.

Regulation 2 of each of the 1956 Regulations specifies the fee which is payable for a certificate of arrest or surrender of a deserter or absentee handed over under section 189(1) of the Army Act 1955 or the Air Force Act 1955. Schedule 13 to the Access to Justice Act 1999 amends section 189 of the Army Act 1955 and the Air Force Act 1955 to provide for the fee to be paid to the proper officer instead of to the clerk of the court. The amendments to each of the 1956 Regulations is consequential to this.
