The British Waterways Board (Limit for Borrowing) Order 2001

The Secretary of State, in exercise of his powers under section 19(3)(iv) of the Transport Act 1962(1), hereby makes the following Order, a draft of which has, in accordance with section 19(3A) of that Act, been approved by resolution of the House of Commons:

Citation and commencement

1.  This Order may be cited as the British Waterways Board (Limit for Borrowing) Order 2001 and shall come into force on the day following the day on which it is made.

Specified limit of borrowing

2.  £35 million is hereby specified for the purposes of section 19(3)(iv) of the Transport Act 1962.

Revocation

3.  The British Waterways Board (Limit for Borrowing) Order 1983(2) is revoked.

Explanatory Note

(This note is not part of the Order)

This Order increases the borrowing limit of the British Waterways Board from £30 million to £35 million, and revokes an earlier order fixing that limit.

1962 c. 46; section 19 was amended by the Transport Act 1968 (c . 73), section 165(a), Schedule 18 Part I; the Transport (London) Act 1969 (c. 35), section 47(2), Schedule 6; the Transport (Financial Provisions) Act 1977 (c. 20), section 3(2)(a); the Water Act 1981 (c. 12), section 1(1) and (2); and the Transport Act 1981 (c. 56), Schedule 12, Part I. Section 19 is amended with effect from 1st April 2001 in connection with sums borrowed for discharging functions within Scotland by paragraph 2(11) of Schedule 2 to the Scotland Act (Cross-Border Public Authorities) (Adaptation of Functions etc.) (No. 2) Order 2000 (S.I. 2000/3251).
