The Secretary of State for the Environment, Transport and the Regions, in exercise of his powers conferred on him by section 20A of the Land Compensation Act 1973(1), and of all other powers enabling him in that behalf, hereby makes the following Regulations:

1.—(1) These Regulations may be cited as the Highways Noise Payments and Moveable Homes (England) (Amendment) Regulations 2000 and shall come into force on 23rd November 2000.

(2) These Regulations extend to England only.

2.  The Highways Noise Payment and Moveable Homes (England) Regulations 2000(2) shall be amended as follows:

(a)in regulation 3(1) (power to make noise payments) for the word “shall” there shall be substituted the word “may”;

(b)in regulation 5(1) (limitations on noise payments) for the words “shall be £1,650” there shall be substituted the words “shall not exceed £1,650”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations correct defects in the Highways Noise Payments and Movable Homes (England) Regulations 2000 (S.I. 2000/2887) to make it clear, in accordance with the enabling powers, that noise payments under regulation 3(1) are discretionary and that the figure of £1,650 mentioned in regulation 5(1) is the maximum noise payment that may be made.

The power to make regulations under section 20A has been devolved to the National Assembly for Wales under the National Assembly for Wales (Transfer of Functions) Order 1999, article 2 and Shedule 1 (S.I. 1999/672).
