In exercise of the powers conferred on the Secretary of State by sections 66(8) and 138(7) of the School Standards and Framework Act 1998(1) the Secretary of State for Education and Employment hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Education (Exclusion from School) (Prescribed Periods) (Amendment) (England) Regulations 2000 and shall come into force on 1st March 2000.

Amendment

2.  In regulation 3(2)(c) of the Education (Exclusion from School) (Prescribed Periods) Regulations 1999(2) (performance of governing body’s duties), in so far as it relates to England, for “30” there shall be substituted “50”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Education (Exclusion from School) (Prescribed Periods) Regulations 1999 in relation to maintained schools in England.

The effect of regulation 2 is that where the head teacher at such a school excludes any pupil in circumstances where the pupil would, as a result of the exclusion, be excluded from the school for a total of more than five but not more than 15 school days in any one term, the governing body must normally take each of the steps referred to in section 66(2) of the School Standards and Framework Act 1998 not later than 50 school days after receiving notification of the exclusion (rather than 30 school days as previously).
