The Local Government Act 2000 (Commencement No. 4) Order 2000

Made

The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred on him by section 108(5) and (7) of the Local Government Act 20001, hereby makes the following Order:

Citation and interpretation1

This Order may be cited as the Local Government Act 2000 (Commencement No. 4) Order 2000.

In this Order references to sections and Schedules are, unless otherwise specified, references to sections of, and Schedules to, the Local Government Act 2000.

This Order applies in relation to England only.

Provisions coming into force on 26th October 20002

The following provisions shall come into force on 26th October 2000—

a

sections 14 to 16, 21, 24, 26, 29 and 102;

b

sections 11, 13, 22, 25, 27, 28, 31, 33 and 37, except in so far as already in force;

c

paragraphs 1 to 5 of Schedule 1 and section 23 to the extent that it relates to those paragraphs;

d

section 39, except subsection (3), and except in so far as already in force;

e

section 46 and Schedule 3;

f

paragraphs 1 to 7, 16 to 23, 29 and 33 of Schedule 5;

g

in Schedule 6, the repeal of the following provisions in the Local Authority Social Services Act 19702

i

section 2(2);

ii

in section 3(1), the words “(hereafter in this Act referred to as “social services functions”)”; and

iii

section 6(5); and

h

section 107 to the extent that it relates to the paragraphs and repeals referred to in paragraphs (f) and (g) of this article.

This Order brings into force, in relation to England only, further provisions of the Local Government Act 2000 (“the Act”).

Article 2 brings into force, on 26th October 2000, further provisions in Part II of the Act concerning local authority executives. These provisions will enable local authority councils to start drawing up detailed executive arrangements for their area and to consult on them. The article also brings into force consequential amendments and repeals of other statutory provisions.
