In exercise of the powers conferred upon him by sections 3(3)(a) and 4(1) of the Immigration Act 1971(1), the Secretary of State hereby makes the following Order:
1. This Order may be cited as the Immigration (Variation of Leave) (Amendment) Order 2000 and shall come into force on 2nd October 2000.
2. In the Immigration (Variation of Leave) Order 1976(2), after paragraph (2)(d) of article 3, there is to be inserted—
“(e)in a case in which the date of the decision is 2nd October 2000 or later.”.

This Order amends the Immigration (Variation of Leave) Order 1976 to exclude from its provisions those who have made an application for variation of limited leave to enter or remain where the decision on the application is not made before 2nd October 2000. Instead, section 3C of the Immigration Act 1971 (continuation of leave pending decision), as inserted by section 3 of the Immigration and Asylum Act 1999(3), will apply to such persons.
