In exercise of the powers conferred on the Secretary of State by sections 485, 489(1) and 569(4) of the Education Act 1996(1), the Secretary of State for Education and Employment hereby makes the following Regulations:

Citation, commencement, extent and application

1.—(1) These Regulations may be cited as the Education (Grants) (Music, Ballet and Choir Schools) (Amendment) (England) Regulations 2000, and shall come into force on 1st September 2000.

(2) These Regulations shall apply only in relation to England.

(3) These Regulations shall apply in relation to a school year beginning on or after the date that they come into force.

Amendment of the Education (Grants) (Music, Ballet and Choir Schools) Regulations 1995

2.—(1) Schedule 1 to the Education (Grants) (Music, Ballet and Choir Schools) Regulations 1995(2) shall be amended as follows.

(2) In paragraph 8 (income), in sub-paragraphs (3) and (5), for “£1,300” in each place where it occurs, there shall be substituted “£1,400”.

(3) In paragraph 13(2) (remission of fees—boarding pupils), for “£9,183” there shall be substituted “£9,382”.

(4) In the table in paragraph 13(3), for “£9,034” there shall be substituted “£9,233”, for “£11,404” in both cases where it appears, there shall be substituted “11,655” and for “£16,025” in both cases where it appears, there shall be substituted “£16,377”.

(5) In paragraph 14 (remission of fees—day pupils)—

(a)in sub-paragraph (2), for “£11,553” there shall be substituted “£11,804”, and

(b)in sub-paragraph (3), for “£11,404” there shall be substituted “£11,655”.

(6) In paragraph 17(3) (uniform grant)—

(a)in sub-paragraph (2) for “£11,965” there shall be substituted “£12,228”,

(b)for sub-paragraph (3)(a) to (d) there shall be substituted—

(a)£187 where the relevant income does not exceed £10,735;

(b)£140 where that income exceeds £10,735 but does not exceed £11,235;

(c)£91 where that income exceeds £11,235 but does not exceed £11,718; and

(d)£47 where that income exceeds £11,718 but does not exceed £12,228.;

(c)in sub-paragraph (5) for “£11,466” there shall be substituted “£11,718”, and

(d)for sub-paragraph (6)(a) and (b) there shall be substituted—

(a)£71 where the relevant income does not exceed £10,901; and

(b)£37 where that income exceeds £10,901 but does not exceed £11,718..

(7) In paragraph 19 (travel grant)—

(a)in sub-paragraph (2)(a), for “£10,683” there shall be substituted “£10,914”; and

(b)in sub-paragraph (2)(b), for “£10,504” there shall be substituted “£10,735”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations further amend the Education (Grants) (Music, Ballet and Choir Schools) Regulations 1995. They come into force on 1st September 2000 and have effect in relation to a school year beginning on or after that date. They apply only in relation to England.

Schedule 1 to the 1995 Regulations (which establishes the aided pupil scheme, sets out conditions of eligibility for aided places, and provides for remission of fees, payment of grant and administrative provisions) is amended as follows—

(a)the reduction to be made (under paragraph 8) in relevant income in respect of dependent relatives pursuant to sub-paragraphs (3) and (5) is increased to £1,400 (from £1,300);

(b)the means tests for the remission of fees (in paragraphs 13 and 14) is relaxed; the level of income at or below which fees are to be wholly remitted is set at £9,382 instead of £9,183 (in respect of boarding pupils) and £11,804 instead of £11,553 (in respect of day pupils), with corresponding increases in the extent of remission where relevant income exceeds those sums;

(c)in paragraph 17 of the 1995 Regulations, the only substantive change is to relax the means tests for uniform grant and increase the amount of grant payable; and

(d)the means test for travel grant (under paragraph 19) is relaxed and the amount of grant payable is increased.
