The Secretary of State, being a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to measures relating to the recognition of higher-education diplomas or formal qualifications required for the pursuit of professions or other occupations, in exercise of the powers conferred on him by that section, hereby makes the following Regulations:

1.  These Regulations may be cited as the European Communities (Recognition of Professional Qualifications) (Amendment) Regulations 2000 and shall come into force on 28th August 2000.

2.  In Regulation 4 of the European Communities (Recognition of Professional Qualifications) Regulations 1991(3) (“the principal Regulations”), after “United Kingdom” there shall be inserted “, other than the profession of company auditor as defined in section 24(2) of the Companies Act 1989 and Article 27(2) of the Companies (Northern Ireland) Order 1990,”.

3.  For Schedule 1 to the principal Regulations there shall be substituted the Schedule set out in the Schedule to these Regulations.

4.  In Schedule 3 to the principal Regulations:

(a)the words “CERTIFIED ACCOUNTANT” shall be omitted; and

(b)after the words “CHARTERED ACCOUNTANT (Scotland)” there shall be inserted “CHARTERED CERTIFIED ACCOUNTANT”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the European Communities (Recognition of Professional Qualifications) Regulations 1991 (S.I. 1991/824, referred to here as “the principal Regulations”) which give effect in the United Kingdom to Council Directive 89/48/EEC (O.J. No. L19, 24.1.89, p. 16) on a general system for the recognition of higher-education diplomas awarded on completion of professional education and training of at least three years' duration.

The amendments comprise the insertion of words in Regulation 4 to clarify the application of the term “designated authority” in that regulation; the insertion of a reference to the profession of chartered certified accountant into Schedule 3 to the principal Regulations in place of a reference to the profession of certified accountant; and the substitution of a new version of Schedule 1 to the principal Regulations. The new Schedule 1 differs from its predecessor in a number of respects: it includes new entries and amended entries, and a number of former entries have now been removed.
