The United Kingdom Transplant Support Service Authority (Establishment and Constitution) Amendment Order 2000

The Secretary of State for Health, in exercise of the powers conferred upon him by sections 11(4)(a) and (c) and 126(3) and (4) of the National Health Service Act 1977(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement, interpretation and extent

1.—(1) This Order may be cited as the United Kingdom Transplant Support Service Authority (Establishment and Constitution) Amendment Order 2000 and shall come into force on 12th July 2000.

(2) In this Order—

“the Authority” means the United Kingdom Transplant Support Service Authority; and

“the Order” means the United Kingdom Transplant Support Service Authority (Establishment and Constitution) Order 1991(2).

(3) This Order extends to England and Wales.

Change of name of the Authority

2.—(1) The Authority shall be called United Kingdom Transplant instead of the United Kingdom Transplant Support Service Authority and, accordingly, in article 2 of the Order for the words “the United Kingdom Transplant Support Service Authority” there are substituted the words “United Kingdom Transplant”.

(2) The change of name under this Order shall not—

(a)affect any right or obligation of any person; or

(b)be taken as invalidating any instrument (whether made before, on or after the day on which this Order comes into force) which refers to the Authority by its previous name; and all instruments and other documents which refer to the Authority under its previous name shall be construed as referring to it under its new name.

Constitution of the Authority

3.  For article 4 of the Order there is substituted the following article—

4.  The Authority shall consist of—

(a)a chairman,

(b)not less than four nor more than seven members who are not officers of the Authority, and

(c)the Chief Officer of the Authority and not more than four other members who are officers of the Authority provided that the number of members who are officers of the Authority shall not exceed the number of members who are not officers of the Authority..

Explanatory Note

(This note is not part of the Order)

This Order changes the name of the United Kingdom Transplant Support Service Authority, a Special Health Authority established under section 11 of the National Health Service Act 1977, to United Kingdom Transplant. It also provides for an increase in the number of members of the Authority.

1977 c. 49; section 11 was amended by the Health Services Act 1980 (c. 53), Schedule 1, paragraph 31, by the National Health Service and Community Care Act 1990 (c. 19) (“the 1990 Act”), Schedule 10, by the Health Authorities Act 1995 (c. 17) (“the 1995 Act”), Schedule 1, paragraph 2 and by the Health Act 1999 (c. 8) (“the 1999 Act”) Schedule 4, paragraph 6; section 126(3) was amended by the 1990 Act, section 65(2) and by the 1995 Act, Schedule 1, paragraph 57; section 126(4) was amended by the 1990 Act, section 65(2) and by the 1999 Act, Schedule 4 paragraph 37(6). Functions exercisable in relation to a cross-border body which by their nature cannot specifically be exercised in relation to Wales are exercisable concurrently by the Secretary of State—see article 2(c) of the National Assembly for Wales (Transfer of Functions) Order 1999, S.I. 1999/672.
