The Secretary of State for Health, in exercise of powers conferred by section 126(4) and 128(1) of, and paragraph 12 of Schedule 5 to, the National Health Service Act 1977(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:
1.—(1) These Regulations may be cited as the Health Authorities (Membership and Procedure) Amendment Regulations 1999 and shall come into force on 24th March 1999.
(2) In these Regulations, “the principal Regulations” means The Health Authorities (Membership and Procedure) Regulations 1996(2).
2. In Schedule 2 to the principal Regulations (Special Health Authorities of which the chairman and members are not disqualified under regulation 10(1)(g))(3), the following entries are inserted at the appropriate point in the alphabetical order: “National Health Service Information Authority”, “National Institute for Clinical Excellence”.

These Regulations amend The Health Authorities (Membership and Procedure) Regulations 1996 (“the principal Regulations”), which make provision for the membership and procedure of Health Authorities.
In particular, they amend Schedule 2 to the principal Regulations (Special Health Authorities of which the chairman and members are not disqualified from being the chairman or a member of a Health Authority) to include the National Health Service Information Authority and the National Institute for Clinical Excellence.
1977 c. 49. Section 126(4) was amended by section 65(2) of the National Health Service and Community Care Act 1990 (c. 19) (“the 1990 Act”); see also section 128(1), which was amended by section 26(2) of the 1990 Act for the definitions of “prescribed” and “regulations”; paragraph 12 of Schedule 5 was amended by paragraph 9 of Schedule 1 to the 1990 Act and by paragraph 60(e) of Schedule 1 to the Health Authorities Act 1995 (c. 17) (“the 1995 Act”). For the definition of “authority” used in paragraph 12 of Schedule 5, see paragraph 8 of Schedule 5; paragraph 8 of Schedule 5 was amended by section 1(7) of, and paragraph 80(2) of Schedule 1 to, the Health Services Act 1980, further amended by paragraph 6 of Schedule 1 to the 1990 Act and further amended by paragraph 60(a) of Schedule 1 to the 1995 Act.
Schedule 2 was amended by S.I. 1997/2991, reg. 2(4).
