Section 1 of the Superannuation Act 1972 (under which the Principal Civil Service Pension Scheme, the Civil Service Additional Voluntary Contribution Scheme and the Civil Service Compensation Scheme have been made) applies to employment and offices listed in Schedule 1 to that Act. This Order adds employment by the New Opportunities Fund and employment by the Data Protection Registrar to those listed in that Schedule.
The New Opportunities Fund (“NOF”) is a body corporate established by section 43A of the National Lottery etc. Act 1993 (c. 39). Section 43A was added by section 7 of the National Lottery Act 1998 (c. 22). The NOF’s powers to appoint staff and to pay pensions are in Schedule 6A to the National Lottery etc. Act 1993, inserted by section 7 of, and Schedule 2 to, the National Lottery Act 1998. The National Lottery Distribution Fund, from which employment in the NOF is remunerated, was established by section 21 of the National Lottery etc. Act 1993.
The office of Data Protection Registrar was established by section 3 of the Data Protection Act 1984 (c. 35). The Registrar’s powers to appoint staff and to pay pensions are in Schedule 2 to the 1984 Act. Section 6(1) of the Data Protection Act 1998 (c. 29) provides for the Data Protection Registrar to be renamed the Data Protection Commissioner, but section 6 of that Act is not in force at the date of the making of this Order.
Under the power conferred by section 1(8)(a) of the Superannuation Act 1972, article 2 of this Order takes effect from the date specified therein.
