The Secretary of State, in exercise of the powers conferred on him by section 11(4) of the Weights and Measures Act 1985(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

1.  These Regulations may be cited as the Weights and Measures (Prescribed Stamp) (Amendment) Regulations 1999 and shall come into force on 30th March 1999.

2.  The Weights and Measures (Prescribed Stamp) Regulations 1968(2) shall be amended as follows–

(a)in regulation 1–

(i)by substituting “by any person authorised by or under section 11 of the Weights and Measures Act 1985(3)” for the word “inspectors”; and

(ii)in paragraph (a), by substituting “,” for “or” in the first place where it occurs and by inserting between “enamelled metal,” and “either” the words “or plastic,”; and

(b)in paragraph (ii) of Schedule 1 and paragraph (iii) of Schedule 2, by substituting “person authorised by or under section 11 of the Weights and Measures Act 1985” for “inspector”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations, which are made under section 11(4) of the Weights and Measures Act 1985 (c. 72), amend the Weights and Measures (Prescribed Stamp) Regulations 1968 (S.I. 1968/1615) to prescribe the stamp for the stamping of weighing and measuring equipment which has been passed as fit for use for trade for use by any person (not only inspectors of weights and measures) authorised to stamp such equipment by or under section 11 of the said 1985 Act.

Further, these Regulations change the stamp prescribed for use in the stamping of a measure made of plastic.

These Regulations have been notified to the European Commission and other member States in accordance with Council Directive 83/189/EEC (OJ No. L109, 26.4.1983, p.8), as last amended by Council Directive 94/10/EC (OJ No. L100, 19.4.1994, p.30) now codified by Directive 98/34/EC of the European Parliament and of the Council (OJ No. L204, 21.7.98, p.37), as amended by Directive 98/48/EC of the European Parliament and of the Council (OJ No. L217, 5.8.98, p.18).
