44. By virtue of rule 16(2) of the Family Proceedings Courts (Matrimonial Proceedings etc) Rules 1991, the issuing of a witness summons under section 97 of the Magistrates' Courts Act 1980 in proceedings under the Domestic Proceedings and Magistrates' Courts Act 1978(1).
