2.—(1) In this regulation “the 1993 Act provisions” means the provisions of paragraph 6 or 7 as appropriate of Schedule 13 to the Education Act 1993(1) (pre-1993 Act transfer of control agreements) which continue to apply to certain agreements by virtue of paragraph 21 of Schedule 39 to the Education Act 1996(2).
(2) Where, immediately before 1st September 1999, the 1993 Act provisions applied to any agreement those provisions shall continue to apply despite the allocation, on that date, of the school in question to a new category under section 20 of, and Schedule 2 to, the School Standards and Framework Act 1998.
