The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred upon him by sections 161(2) and (3), 172(4), 185(2) and (3) and 215 of the Housing Act 19961, and of all other powers enabling him in that behalf, hereby makes the following Regulations:–
Citation, commencement and extent1

These Regulations may be cited as the Allocation of Housing and Homelessness (Amendment) (England) Regulations 1999 and shall come into force on 24th August 1999.

Classes prescribed under section 161(2) of the Housing Act 1996 who are qualifying persons2
In regulation 4 of the Allocation of Housing Regulations 19962, at the end, there shall be inserted the following class–
Class CB (this applies in relation to England only) – a person who left the territory of Montserrat after 1st November 1995 because of the effect on that territory of a volcanic eruption.
Classes prescribed under section 161(3) of the Housing Act 1996 who are qualifying persons3
In regulation 5 of the Allocation of Housing Regulations 1996, at the end, there shall be inserted the following class–
Class EA (this applies in relation to England only) – a person who left the territory of Montserrat after 1st November 1995 because of the effect on that territory of a volcanic eruption.
Classes of persons subject to immigration control who are eligible for housing assistance4
In regulation 3(1) of the Homelessness Regulations 19963, at the end, there shall be inserted the following class–
Class I (this applies in relation to England only) – a person who left the territory of Montserrat after 1st November 1995 because of the effect on that territory of a volcanic eruption.
Descriptions of persons who are to be treated as persons from abroad ineligible for housing assistance5

Regulation 4 of the Homelessness Regulations 19964 is amended as follows.

At the beginning, there shall be inserted “(1)”.

After paragraph (a)(iv), there shall be inserted–

a person who is on an income-based jobseeker’s allowance or in receipt of income support;

Paragraph (1)(a)(v) applies in relation to England only and the definitions in regulation 3(2)(a), (b) and (c) shall apply for the purposes of that paragraph.
