CIVIL AVIATION

The Stansted Airport Aircraft Movement Limit (Amendment) Order 1999

Made

26th July 1999

Coming into force

27th July 1999

Whereas it appears to the Secretary of State for the Environment, Transport and the Regions that the existing runway capacity of Stansted Airport is not fully utilised for a substantial proportion of the time for which its runway is available for the take-off or landing of aircraft,

And whereas the Secretary of State considers it appropriate to impose a higher limit on the number of occasions on which aircraft may take-off or land at Stansted Airport than the limit imposed by the Stansted Airport Aircraft Movement Limit Order 1987(1),

And whereas a draft of this Order has been laid before and approved by a resolution of each House of Parliament in accordance with section 79(3) of the Airports Act 1986(2),

Now, therefore, the Secretary of State, in exercise of the powers conferred by section 32 of the Airports Act 1986, and after consultation with the Civil Aviation Authority, the airport operator and such of the other persons referred to in section 32(6) as he considered appropriate, hereby makes the following Order–

1.  This Order may be cited as the Stansted Airport Aircraft Movement Limit (Amendment) Order 1999 and shall come into force on the day after the day on which it is made.

2.  For article 2 of the Stansted Airport Aircraft Movement Limit Order 1987, there shall be substituted–

2.  Subject to article 3, at Stansted Airport the number of occasions on which aircraft may take-off or land shall be limited–

(a)to 120,000 in the period commencing on the date of coming into force of this Order and ending on 29th February 2000; and

(b)to 185,000 in each succeeding period of one year commencing on 1st March 2000..

Signed by authority of the Secretary of State
