In exercise of the powers conferred upon him by sections 29(3), (4) and (8A) of the Representation of the People Act 1983(1) as applied by article 18 of the Scottish Parliament (Elections etc.) Order 1999(2) the Secretary of State hereby makes the following Order with the consent of the Treasury:

Citation and commencement

1.  This Order may be cited as the Scottish Parliamentary Elections (Returning Officers' Charges) (Amendment) Order 1999 and shall come into force on 18 June 1999.

Amendment of the Scottish Parliamentary Elections (Returning Officers' Charges) Order 1999

2.—(1) The Scottish Parliamentary Elections (Returning Officers' Charges) Order 1999 is amended as follows.

(2) In the definition of “by-election” in article 1(2) for “8” there is substituted “9”.

(3) In article 3(1)(b) for “7” where it appears in the second place there is substituted “8”.

Explanatory Note

(This note is not part of the Order)

This Order amends the Scottish Parliamentary Elections (Returning Officers' Charges) Order 1999 as a consequence of an error in articles 1(2) and 3(1)(b) of that Order.

1983 c. 2 Section 29 has been amended by section 1 of the Representation of the People Act 1991 (c. 11) and by the Transfer of Functions (Returning Officers' Charges) Order 1991 (S.I. 1999/1228); the functions formerly conferred on the Treasury have been transferred to the Secretary of State by that Order. The powers conferred in section 29(3) have been extended by paragraph 3(3) of Schedule 5 to the Scottish Parliament (Elections etc.) Order 1999.
