The Broadcasting (Guernsey) Order 1999

The Queen’s Most Excellent Majesty in Council

Her Majesty, in pursuance of section 150(4) of the Broadcasting Act 1996(1), and section 204(6) of the Broadcasting Act 1990(2), as it is applied by section 150(3) of the Broadcasting Act 1996, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:–

1.  This Order may be cited as the Broadcasting (Guernsey) Order 1999 and shall come into force on 12th May 1999.

2.  Section 94 of the Broadcasting Act 1996 shall extend to the Bailiwick of Guernsey.

3.  In the Schedule to the Broadcasting Act 1990 (Guernsey) (No. 2) Order 1991(3), after paragraph 29, there shall be inserted–

“29A.   Omit section 104A.

29B.   In section 104B–

(a) in subsection (1)(b), for the words from “category B” to the end substitute “any of the categories of local service for the time being specified in this paragraph as it has effect in the United Kingdom”;

(b) in subsection (2)(b), after “United Kingdom” insert “or the Bailiwick of Guernsey”;

(c) omit subsections (6) and (7).”.

Explanatory Note

(This note is not part of the Order)

This Order extends to the Bailiwick of Guernsey section 94 of the Broadcasting Act 1996, which relates to the renewal of licences to provide local radio services, and amends the Broadcasting Act 1990 (Guernsey) (No. 2) Order 1991 (S.I. 1991/1709), which extends the Broadcasting Act 1990, with modifications, to Guernsey.

The effect of the Order is to extend to Guernsey, with modifications, the new section 104B (but not the new section 104A) inserted in the 1990 Act by section 94 of the 1996 Act and to amend section 104B of the 1990 Act as it extends to Guernsey.
