The Secretary of State, in exercise of the power conferred upon him by sections 12(4) and 30(1)(b) of the Criminal Justice Act 1991(1), hereby makes the following Order:

1.  This Order may be cited as the Curfew Order (Responsible Officer) (Amendment) Order 1999 and shall come into force on 28th January 1999.

2.—(1) The Curfew (Responsible Officer) Order 1997(2) is amended as follows.

(2) In article 3, the words “Berkshire,” and “, the London Borough of Barnet, Brent, Ealing, Enfield, Haringey, Harrow, Hillingdon or Hounslow,” shall be omitted.

(3) After article 3, there shall be inserted—

3A.(1) Where a curfew order specifies a place in Berkshire as a place of curfew the responsible officer shall be an employee of Securicor Custodial Services Limited of Sutton Park, 15 Carshalton Road, Sutton, Surrey SM1 4LD or of GSSC of Europe, Limited of Carmelite, 50 Victoria Embankment, London EC4Y 0DX.

(2) On and after 28th February 1999, paragraph (1) shall have effect as if the words “of Securicor Custodial Services Limited of Sutton Park, 15 Carshalton Road, Sutton, Surrey SM1 4LD or” were omitted.

3B.(1) Where a curfew order specifies a place in the London Borough of Barnet, Brent, Ealing, Enfield, Haringey, Harrow, Hillingdon or Hounslow as a place of curfew the responsible officer shall be an employee of Securicor Custodial Services Limited of Sutton Park, 15 Carshalton Road, Sutton, Surrey SM1 4LD or of Premier Monitoring Services Limited of Centennial Court, Easthampstead Road, Bracknell, Berkshire RG12 1YQ.

(2) On and after 28th February 1999, paragraph (1) shall have effect as if the words “of Securicor Custodial Services Limited of Sutton Park, 15 Carshalton Road, Sutton, Surrey SM1 4LD or” were omitted..

Explanatory Note

(This note is not part of the Order)

This Order amends the description of persons who are to be made responsible, by a curfew order relating to a place of curfew in Berkshire or the London Borough of Barnet, Brent, Ealing, Enfield, Haringey, Harrow, Hillingdon or Hounslow, for monitoring an offender’s whereabouts during the curfew period.

The Order further provides that for one calendar month the company which currently employs responsible officers in these areas will share that function with the companies which will take over that function alone on 28th February 1999.
