The Secretary of State, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 1988(1), and of all other powers enabling him in that behalf, hereby makes the following Order:
1. This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemptions) (Hastings and Luton Borough Councils) Order 1998 and shall come into force on 19th January 1999.
2. The supervision of parking(2) by the Council of the Borough of Hastings (“Hastings”) and the Council of the Borough of Luton (“Luton”) shall not be treated as a defined activity so long as it is carried out–
(a)by Hastings within the borough of Hastings and during the period beginning with 10th May 1999 and ending immediately before 1st November 2000;
(b)by Luton within the borough of Luton and during the period beginning with 19th January 1999 and ending immediately before 19th January 2001.

Under Part I (competition) of the Local Government Act 1988 work falling within certain defined activities may be carried out by local authorities only if particular conditions are fulfilled.
This Order exempts from the requirements of Part I the supervision of parking within the borough of Hastings by Hastings Borough Council from 10th May 1999 to 31st October 2000 and within the borough of Luton by Luton Borough Council from 19th January 1999 to 18th January 2001.
