In exercise of the powers conferred on the Secretary of State by section 144(1) and (3) of the School Standards and Framework Act 1998(1), the Secretary of State for Education and Employment hereby makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the School Standards and Framework Act 1998 (Allowances for Governors and Individual Pupil Information) (Modification) Regulations 1998 and shall come into force on 15th December 1998.

(2) In these Regulations–

“the 1996 Act” means the Education Act 1996(2); and

“the 1998 Act” means the School Standards and Framework Act 1998.

Modification of the 1996 Act

2.  In relation to any time before the appointed day(3), section 519 of the 1996 Act, as amended by paragraph 139 of Schedule 30 to the 1998 Act(4), shall have effect as if the reference to the governors of any community, foundation or voluntary school or community or foundation special school included a reference to the governors of any county, voluntary, maintained special, grant-maintained or grant-maintained special school within the meaning of the 1996 Act.

3.  In relation to any time before the appointed day, section 537A of the 1996 Act(5) shall have effect as if the reference to the governing body of every school which is maintained by a local education authority included the governing body of every grant-maintained school within the meaning of the Education Act 1996.

Explanatory Note

(This note is not part of the Regulations)

Paragraph 139 of Schedule 30 to the School Standards and Framework Act 1998 amends section 519 of the Education Act 1996, which relates to the payment of allowances to, inter alia, governors of schools which do not have delegated budgets and of institutions of further education maintained by local education authorities. As from 20th November 1998, the amendments to that section are in force for the purposes of making schemes and regulations under that section and are in force for all other purposes as from 1st April 1999.

The categories of school referred to in section 519, as so amended, will not exist until 1st September 1999 and so these Regulations modify that section, as amended, so that it includes reference to the governors of county, voluntary, maintained special, grant-maintained and grant-maintained special schools in the period up to 1st September 1999.

Paragraph 153 of Schedule 30 to the Act substitutes a new section 537A in the Education Act 1996 as from 20th November 1998. Section 537A relates to the provision of information about individual pupils. That section as substituted applies in relation to schools maintained by local education authorities, special schools not so maintained and independent schools.

These Regulations modify that section so that, until 1st September 1999, the reference to schools maintained by local education authorities includes grant-maintained schools.
