2.  In this Order, “landfill gas generating stations” means generating stations which are fuelled wholly by gas derived from landfill sites on which, at any time before 25th November 1997, activities were carried on in accordance with a licence issued under section 5 of the Control of Pollution Act 1974(1), or a resolution passed by the relevant disposal authority pursuant to section 11(3)(e) of that Act, or a waste management licence issued under section 36 of the Environmental Protection Act 1990(2).
