Explanatory Note

(This note is not part of the Regulations)

Section 2 of the School Standards and Framework Act 1998 came into force on 24th July 1998. Section 2(1) requires every local education authority to prepare a statement (referred to in these Regulations as “the plan”) setting out the arrangements which the authority propose to make for the purpose of securing that the limit on the size of infant classes imposed under section 1 of that Act is complied with in relation to schools maintained by that authority. The plan has to be submitted to the Secretary of State for his approval.

These Regulations prescribe;

(a)for the purposes of section 2(2), what information concerning the proposed arrangements the plan must contain, and the form which the plan has to take (regulation 3 and the Schedule);

(b)for the purposes of section 2(3), the persons and bodies whom the authority are required to consult when preparing the plan (regulation 4);

(c)for the purposes of section 2(4), the persons and bodies who are required to provide documents, information and other assistance to the authority in connection with the preparation of the plan (regulation 5); and

(d)for the purposes of section 2(5), 16th October 1998 as the date by which every local education authority are required to submit their plan to the Secretary of State (regulation 6).
