Whereas the Secretary of State for Education and Employment has received a proposal from the Further Education Funding Council for England, made in accordance with section 51 of the Further and Higher Education Act 1992(1) (“the Act”), for the establishment of a body corporate under section 16(1)(a) of the Act;
Now therefore, in exercise of the powers conferred on him by sections 16(1) and 17 of the Act and for the purpose of giving effect to that proposal, the Secretary of State hereby makes the following Order:
1. This Order may be cited as The Bolton Sixth Form College (Incorporation) Order 1998 and shall come into force on 22nd June 1998 (“the Commencement Date”).
2. On the Commencement Date there shall be established a body corporate called “Bolton Sixth Form College” for the purpose of establishing and conducting from the operative date a new educational institution of that name (to be formed by the merger of North Bolton Sixth Form College and South College, Bolton).
3. The “operative date” in relation to the further education corporation established by this Order shall be 1st August 1998, and the corporation shall conduct Bolton Sixth Form College from that date.

This Order establishes a further education corporation under section 16(1) of the Further and Higher Education Act 1992 for the purpose of establishing and conducting Bolton Sixth Form College and appoints 1st August 1998 as the “operative date” for the purposes of Part I of that Act.
