Exemptions

4.  The controls specified in article 3 do not apply to:—

(a)a vehicle being used under a licence under section 6 of the Metropolitan Public Carriage Act 1869(1) for the sole purpose of stopping for a period not exceeding two minutes to pick up or set down any passenger;

(b)a vehicle being used for ambulance, fire brigade or police purposes;

(c)a vehicle being used in the service of a local authority for the purpose of collecting refuse from premises adjacent to a cycle lane;

(d)a vehicle being used in connection with the removal of any obstructions to traffic;

(e)a vehicle being used in connection with the maintenance, improvement or reconstruction of a cycle lane;

(f)a vehicle entering a cycle lane so as to avoid an accident;

(g)a vehicle entering a cycle lane to get or give help in consequence of an accident or an emergency or otherwise taking action for public safety;

(h)a vehicle which bears the Royal Mail livery for so long as may be required for the purpose of collecting or delivering letters in pursuance of any statutory duty of the Post Office to collect or deliver letters;

(i)a vehicle entering and forthwith leaving a cycle lane in order to gain access to or egress from any vehicular access way to premises adjacent to the cycle lane or crossing over the footway adjacent to the cycle lane;

(j)a disabled person’s vehicle which displays a disabled person’s badge in the relevant position to stop for so long as may be required to enable a disabled person to get on or off the vehicle; or

(k)anything done with the permission or at the direction of a police constable in uniform or a traffic warden.
