The Litter Control Areas (Amendment) Order 1997

The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on them by section 90(1) and (2) of the Environmental Protection Act 1990(1), and sections 63 and 75(3) and (4) of the Environment Act 1995(2), and of all other powers enabling them in that behalf, and the Secretary of State for Scotland, as respects Scotland, in exercise of the powers conferred on him by section 90(1) and (2) of the Environmental Protection Act 1990 and of all other powers enabling him in that behalf, hereby make the following Order:—

Citation and commencement

1.  This Order may be cited as the Litter Control Areas (Amendment) Order 1997 and shall come into force on 28th March 1997.

Amendment of the Litter Control Areas Order 1991

2.—(1) Article 2 of the Litter Control Areas Order 1991(3) (land which may be designated as a litter control area) shall be amended in accordance with the following provisions of this article.

(2) In paragraph (1)(b), the words “which has a gross retail floorspace of 5,000 square metres or more” shall be omitted.

(3) In paragraph (1)(c), the words “with a gross floor space of 5,000 square metres or more” shall be omitted.

(4) There shall be substituted for paragraph (1)(j)(xi):

(xi)A National Park Authority, or.

Amendment of the National Park Authorities (Wales) Order 1995

3.—(1) Paragraph 16 of Schedule 5 to the National Park Authorities (Wales) Order 1995(4) shall be omitted.

(2) The entry headed “The Litter Control Areas Order 1991” in paragraph 2 of the Schedule to the National Park Authorities (Wales) (Amendment) Order 1996 shall be omitted.

Amendment of the National Park Authorities (England) Order 1996

4.  Paragraph 13 of Schedule 5 to the National Park Authorities (England) Order 1996(5) shall be omitted.

Explanatory Note

(This note is not part of the Order)

This Order amends two of the prescribed descriptions of land (retail shopping developments, and business or office parks or industrial or trading estates) which may be designated as litter control areas under section 90(3) of the Environmental Protection Act 1990. It also substitutes a reference to the new National Park Authorities created under the Environment Act 1995 for the existing reference to joint or special planning boards, and makes consequential revocations.
