The Secretary of State for the Environment as respects England, the Secretary of State for Wales as respects Wales and the Secretary of State for Scotland as respects Scotland, in exercise of the powers conferred on them by sections 52(8) and 74(6) of the Environmental Protection Act 19901 and of all other powers enabling them in that behalf, hereby make the following Regulations:
Citation and commencement1

These Regulations may be cited as the Waste Management (Miscellaneous Provisions) Regulations 1997 and, except for regulation 2, shall come into force on 1st April 1997.

Regulation 2 shall come into force on 14th March 1997.
Relevant Offences2
An offence shall be a relevant offence for the purposes of section 74(3)(a) of the Environmental Protection Act 1990 (in addition to the offences prescribed by regulation 3 of the Waste Management Licensing Regulations 19942) if it is an offence under paragraph 15(1), (3), (4) or (5) of Schedule 5 to the Finance Act 1996 (landfill tax)3.
Amendment of the Environmental Protection (Waste Recycling Payments) Regulations 19923
For the Schedule to the Environmental Protection (Waste Recycling Payments) Regulations 19924 there shall be substituted the following –
THE SCHEDULEREPRESENTATIVE SAVINGS IN WASTE DISPOSAL COSTS
Type of waste disposal authority
Saving in waste disposal costs per tonne
A London waste disposal authority for an area which includes an inner London borough. The council of an inner London borough. The Common Council of the City of London.
£44.58
A London waste disposal authority which comprises outer London boroughs. The council of an outer London borough.
£38.87
The Greater Manchester Waste Disposal Authority. The Merseyside Waste Disposal Authority. The council of a metropolitan district.
£32.06
Any other waste disposal authority.
£25.22 where the authority incurs any transport costs in disposing of similar waste and £17.25 in other cases.
Revocation of regulations4
The following regulations (each of which substituted a new Schedule to the 1992 Regulations) are hereby revoked—
a
the Environmental Protection (Waste Recycling Payments) (Amendment) Regulations 19935;
b
regulation 2(3) of the Environmental Protection (Waste Recycling Payments) (Amendment) Regulations 19946;
c
the Environmental Protection (Waste Recycling Payments) (Amendment) Regulations 19957;
d
regulation 6 of the Waste Management Regulations 19968.
