The Reserve Forces Act 1996 (Commencement No. 1) Order 1997

The Secretary of State, in exercise of the powers conferred on him by section 132(4) of the Reserve Forces Act 1996(1), hereby makes the following Order:—

1.  This Order may be cited as the Reserve Forces Act 1996 (Commencement No. 1) Order 1997.

2.—(1) Subject to paragraph (2) below, the Reserve Forces Act 1996 shall come into force on 1st April 1997.

(2) The repeal by Schedule 11 to the 1996 Act of provisions of the Reserve Forces Act 1980(2) shall not be brought into force by paragraph (1) above so far as it relates to the following provisions of the 1980 Act, namely, sections 10, 11, 13(2) to (4), 16, 17, 18(1) and (2), 19, 20(1), 21, 22, 24 to 26, 28, 29, 30(1) and (2), 31, 32, 34(1) to (3), 35, 36, 38, 39(1)(a) and (b), 40 to 42, 44, 47, 50, 57, 58, 63, 67, 69, 70, 83(1) and (2), 87, 93, 100, 101, 120, 139(1), 141 to 144, 145(1)(b) and (2), 146(1)(b) and (2), 154(1), 155, Schedule 2 and Schedule 8, paragraphs 1, 4, 5(1) and (3), 6 to 8, 10 to 15, 16(2), (3) and (5) to (10), 17, 19 and 20.

Explanatory Note

(This note is not part of the Regulations)

This Order brings into force all of the provisions of the Reserve Forces Act 1996 except for section 121(2) (which came into force on the passing of the Act, namely 22nd May 1996) and Schedule 11 to the extent that it provides for the repeal of the provisions in the Reserve Forces Act 1980 listed in article 2(2) of this Order. Sections 48, 55, 130 to 138, 140, 151 and 156 to 158 of the 1980 Act are also not repealed by the coming into force of the 1996 Act as they are expressly excluded from repeal by Schedule 11.
