Her Majesty, in exercise of the powers conferred on Her by section 2(2) of the European Communities Act 19721, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

This Order may be cited as the Immigration (European Economic Area) (Amendment) Order 1997 and shall come into force on 1st February 1998.

The Immigration (European Economic Area) Order 19942 shall be amended as follows:
a
for article 6(2)(h)(ii) there shall be substituted—
ii
assures the Secretary of State by means of a declaration or by such alternative means as he may choose that are at least equivalent that he has sufficient resources to avoid him becoming a burden on the social assistance system of the United Kingdom, and
b
for article 12(6) there shall be substituted—

In the case of a retired person or a self-sufficient person the Secretary of State may, if he deems it necessary, require the revalidation of the residence permit at the end of the first two years of residence.
