Coming into force
The Secretary of State, in exercise of the powers conferred on him by section 12A(1) of and paragraphs 1 and 3(1)(b) of Schedule 7A to the National Health Service (Scotland) Act 19781, and of all other powers enabling him in that behalf, hereby makes the following Order:
Citation, commencement and interpretation1

This Order may be cited as the Dundee Teaching Hospitals National Health Service Trust (Establishment) Amendment Order 1997 and shall come into force on 16th December 1997.

In this Order “the principal Order” means the Dundee Teaching Hospitals National Health Service Trust (Establishment) Order 19922.
Amendment of Article 3 of the principal Order2
For article 3 of the principal Order there shall be substituted the following:

The trust is established for the purposes specified in section 12A(1) of the Act.

The trust’s functions (which include functions which the Secretary of State considers appropriate in relation to the provision of services by the trust for one or more health boards) shall be–
a
to own and manage under section 12A(1)(a) of the Act the hospital establishments or facilities known as the Ninewells Hospital, Dundee Royal Infirmary, King’s Cross Hospital and Dundee Dental Hospital, all Dundee, and Dundee Limb Fitting Centre, Broughty Ferry, and establishments associated with these hospitals, including management of the facilities provided at and from those establishments, and also including the management of the teaching and research facilities associated with these establishments and the support services related thereto; and
b
to provide and manage under section 12A(1)(b) of the Act facilities comprising a new Orthotics Department, clinical out-patients accommodation, a multi-storey car park, surface car parking and associated facilities all at Ninewells Hospital, Dundee.
