3. Article 3(1) of the Transport and Works (Descriptions of Works Interfering with Navigation) Order 1992 shall be amended:
(a)by inserting after the definition of “cable” the following:
““fountain” means a structure or device (whether fixed or floating) used, or intended to be used, to project jets of water from static or manoeuvrable nozzles;”;
(b)by inserting after the definition of “navigational aid” the following:
““observation structure” means a structure (whether fixed or floating) with a platform or gallery for viewing events, objects or the surrounding region;”; and
(c)in the definition of “pier” by inserting after the words “(whether fixed or floating)” the words “, together with any building thereon,” and by substituting for the words “promenading or other recreational purposes” the words “commercial, residential or leisure purposes”.
