The Minister of Agriculture, Fisheries and Food and the Secretaries of State respectively concerned with sea fishing in Scotland, Wales and Northern Ireland, in exercise of the powers conferred on them by section 30(2) of the Fisheries Act 1981(1) and of all powers enabling them in that behalf, hereby make the following Order:

Title and commencement

1.  This Order may be cited as the Sea Fishing (Enforcement of Community Conservation Measures) (Amendment) Order 1997 and shall come into force on 22nd December 1997.

Amendment of the principal Order

2.—(1) The Sea Fishing (Enforcement of Community Conservation Measures) Order 1997(2) shall be amended in accordance with paragraph (2) below.

(2) In article 10 (protection of officers) and paragraph (c) of article 11 (obstruction of officers) there shall be substituted for the words “articles 6 to 8 of this Order” the words “articles 6 to 9 of this Order”.

Explanatory Note

(This note is not part of the Order)

This Order, which amends the Sea Fishing (Enforcement of Community Conservation Measures) Order 1997, (“the principal Order”), extends the protection against civil or criminal proceedings afforded by article 10 of the principal Order to those officers other than British Sea Fishery Officers who are empowered to enforce aspects of the principal Order. It also provides that assault, or intentional obstruction, of such officers is an offence.
