The Education (Schools) Act 1997 (Commencement) Order 1997

The Secretary of State, in exercise of the powers conferred on him by section 7(3)(b) of the Education (Schools) Act 19971 and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation1

This Order may be cited as the Education (Schools) Act 1997 (Commencement) Order 1997.

Commencement of provisions2

The following provisions of the Education (Schools) Act 1997 shall come into force on 1st December 1997:–

  • section 5(2),

  • section 6(3) so far as relating to Part II of the Schedule, and

  • Part II of the Schedule.

The Education (Schools) Act 1997 provides for the phasing out of the Assisted Places Scheme in England and Wales and Scotland after the beginning of the first term of the school session 1997/98. This Order commences on 1st December 1997 sections 5(2) and 6(3) (in part) and Part II of the Schedule to the Act which revoke provisions in the Education (Scotland) Act 1980 made redundant by this phasing out. As a result of commencement of these provisions of the 1997 Act, regulations 3 to 6 and 25 and 26 of the Education (Assisted Places) (Scotland) Regulations 1995 (S.I.1995/1713) cease to have effect.

The other provisions in the 1997 Act relating to the phasing out of the Scheme in Scotland came into force on 31st July 1997.
