Amendment to the Family Proceedings Fees Order 1991

2.  Article 3 of the Family Proceedings Fees Order 1991(1) shall be amended as follows—

(a)the existing article shall be re-numbered as article 3(1);

(b)in sub-paragraph (b) of the new paragraph (1), for the words from “income support” to “1992” there shall be substituted “any qualifying benefit”;

(c)after the new paragraph (1) there shall be inserted the following new paragraph—

(2) The following are qualifying benefits for the purposes of paragraph (1)(b) above: income support, family credit and disability working allowance under Part VII of the Social Security Contributions and Benefits Act 1992(2), and income-based jobseeker’s allowance under the Jobseekers Act 1995(3)..
