The Social Security Administration (Fraud) Act 1997 (Commencement No. 3) Order 1997

The Secretary of State for Social Security, in exercise of the powers conferred on her by section 25(1) and (2) of the Social Security Administration (Fraud) Act 1997(1) and of all other powers enabling her in that behalf, hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Social Security Administration (Fraud) Act 1997 (Commencement No. 3) Order 1997.

(2) In this Order, references to “the Act” are references to the Social Security Administration (Fraud) Act 1997.

Appointed days

2.—(1) The day appointed for the coming into force of section 11 of the Act (information from landlords and agents) is 8th October 1997.

(2) The day appointed for the coming into force of section 16 of the Act (recovery of overpaid housing benefit)—

(a)for the purposes only of authorising the making of regulations is 8th October 1997; and

(b)for all other purposes is 3rd November 1997.

Explanatory Note

(This note is not part of the Order)

This Order provides for the coming into force of section 11 of the Social Security Administration (Fraud) Act 1997 (which concerns the obtaining of information from landlords and agents) on 8th October 1997. It also provides for the coming into force of section 16 of that Act (which concerns recovery of overpaid housing benefit) for the purposes of making regulations on 8th October 1997 and for all other purposes on 3rd November 1997.
