The Secretary of State, in exercise of the powers conferred on him by sections 161(3) and 185(3) of the Housing Act 1996(1), and of all other powers enabling him in that behalf, hereby makes the following Regulations:
1.—(1) These Regulations may be cited as the Allocation of Housing and Homelessness (Amendment) (No. 2) Regulations 1997 and shall come into force on 27th August 1997.
(2) In these Regulations—
“the Allocation Regulations” means the Allocation of Housing Regulations 1996(2); and
“the Homelessness Regulations” means the Homelessness Regulations 1996(3).
2. In regulation 6 of the Allocation Regulations (classes prescribed under section 161(3) of the Housing Act 1996 who are not qualifying persons), in the description of Class F, at the end, add—
“(iv)a person who left the territory of Montserrat after 1st November 1995 because of the effect on that territory of a volcanic eruption;”.
3. In regulation 4 of the Homelessness Regulations (descriptions of persons who are to be treated as persons from abroad ineligible for housing assistance), in paragraph (a), at the end, add—
“(iv)a person who left the territory of Montserrat after 1st November 1995 because of the effect on that territory of a volcanic eruption;”.

These Regulations amend the classes of persons prescribed under section 161(3) of the Housing Act 1996 (allocation only to qualifying persons) as not qualifying for the allocation of housing accommodation and the descriptions, for which provision is made under section 185(3) of the 1996 Act (persons from abroad not eligible for housing assistance), of persons to be treated as persons from abroad who are ineligible for housing assistance. In each case, the effect of the amendment is to except from the test of habitual residence in the Common Travel Area a person who left the territory of Montserrat after 1st November 1995 because of the effect on that territory of a volcanic eruption.
