The Secretary of State, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 1988(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Local Government Act 1988 (Defined Activities) (Exemption) (Hackney and Southwark London Borough Councils and Liverpool City Council) Order 1997 and shall come into force on 29th August 1997.

Exemption of financial services

2.  The provision of financial services(2) by Hackney London Borough Council shall not be treated as a defined activity so long as it is carried out before 23rd February 1998.

Exemption of grounds maintenance

3.  The maintenance of ground(3) by Southwark London Borough Council shall not be treated as a defined activity so long as it is carried out before 6th April 1998.

Exemption of sports and leisure facilities management

4.  The management of sports and leisure facilities(4) by Liverpool City Council shall not be treated as a defined activity so long as—

(a)it is carried out at Beechley Riding Stables, Harthill Road, Calderstones Park, Liverpool L18 4TU; and

(b)that facility is provided for use predominantly by disabled persons (within the meaning of Part I of the Housing Grants, Construction and Regeneration Act 1996(5)).

Explanatory Note

(This note is not part of the Order)

Under Part I of the Local Government Act 1988 (competition), work falling within certain defined activities may be carried out by local authorities only if specified conditions are fulfilled.

This Order exempts from the requirements of Part I—

(a)the provision of financial services by Hackney London Borough Council so long as it is carried out before 23rd February 1998;

(b)the maintenance of ground by Southwark London Borough Council so long as the work is carried out before 6th April 1998; and

(c)sports and leisure facilities management by Liverpool City Council at the riding centre named in article 4 so long as it is provided for use predominantly by disabled persons.
