Explanatory Note

(This note is not part of the Order)

This Order, which supersedes the Land Registration Fees Order 1996 (“the 1996 Order”) and takes effect on 1st April 1997, reduces overall the fees payable in relation to applications made and services provided under the Land Registration Acts 1925 to 1986 and the Rules made under the Land Registration Act 1925 (“the Act”). It does so by:

(1) amending the principal ad valorem fee scale, Scale 1 (which applies to applications for first registration of land and applications to register certain dispositions for monetary consideration affecting registered land) so as to reduce by £10 the fees payable for those applications whose value or amount falls within one of the fee bands relating to values or amounts exceeding £30,000 but not exceeding £150,000 (articles 2, 3, 16 and 17; Schedule 1);

(2) reducing from £3 to £2 the fee for an inspection of the register or any part of the register (to include the making of a copy of or extract from the register) on any one occasion when a person gains access to the Registrar’s computer system by means of that person’s remote terminal pursuant to rule 4A of the Land Registration (Open Register) Rules 1991 (article 10; Schedule 3, Part II, paragraph (1)).

(3) reducing to £4 the fixed fee for those services (other than the taking of an affidavit or declaration) which attracted a fixed fee of £5 under the 1996 Order (article 10; Schedule 3, Parts II, III and IV);

(4) reducing from £10 to £8 the fee (per document) for the inspection or supply of an office copy (or both) in relation to a lease or mortgage referred to in the register, or copy thereof, or of any document not referred to in a register, and the fee per title for the supply of information under section 129 of the Act (article 10; Schedule 3, Part II, paragraph (4) and Part IV, paragraph (3));

(5) reducing from £50 to £40 the fee for the supply of a copy of an Index Map section (article 10; Schedule 3, Part IV, paragraph (2)).
