In exercise of the powers conferred on me by section 53(3) and (4) of the Firearms (Amendment) Act 1997(1), I hereby make the following Order:

Citation and commencement

1.  This Order may be cited as the Firearms (Amendment) Act 1997 (Commencement) (No. 2) (Amendment) Order 1997.

2.  For article 4 of the Firearms (Amendment) Act 1997 (Commencement) (No. 2) Order 1997(2) there shall be substituted:

4.  Sections 1(2) (prohibition of certain small firearms) and 9 (prohibition of expanding ammunition) of the 1997 Act shall not have effect until 1st October 1997 in relation to the possession, sale or transfer of a firearm or ammunition by a person who, immediately before 1st July 1997, has the firearm or ammunition in his possession by virtue of:

(a)a firearm certificate or a visitor’s firearm permit, or

(b)a permit issued under section 7 of the 1968 Act.

4A.  Section 1(2) of the 1997 Act shall not have effect until 1st October 1997 in relation to the possession, purchase, acquisition, sale or transfer of a firearm by a registered firearms dealer..

Explanatory Note

(This note is not part of the Order)

This Order amends the Firearms (Amendment) Act 1997 (Commencement) (No. 2) Order 1997 (“the Commencement (No. 2) Order”) by substituting, for article 4, new articles 4 and 4A with the effect that, in addition to the provision made by the existing article 4, the prohibition of firearms by s. 1(2) of the 1997 Act is not to have effect until 1st October 1997 in relation to the acquisition or purchase of a firearm by a registered firearms dealer.

(The Commencement (No. 2) Order brings section 1(2) of the 1997 Act into force on 1st July 1997, subject to the other provisions of that Order (including article 4).)
