Explanatory Note

(This note is not part of the Regulations)

The Motor Vehicles (Approval) (Amendment) Regulations 1997 (S.I. 1997/1366) amend the Motor Vehicles (Approval) Regulations 1996 (S.I. 1996/3013) (“the Approval Regulations”) so as to postpone the date appointed by those Regulations for the purposes of section 63(1) of the Road Traffic Act 1988 from 1st July 1997 to 1st January 1998.

As a consequence of this, these Regulations amend the Road Vehicles (Construction and Use) (Amendment) (No. 6) Regulations 1996 (“the 1996 Regulations”), which in turn amend the Road Vehicles (Construction and Use) Regulations 1986 (“the 1986 Regulations”).

By virtue of regulation 2, paragraphs (10) and (10B)(c) of regulation 61 (emissions) of the 1986 Regulations will continue to apply in relation to amateur-built vehicles first used before 1st January 1998, subject to modifications (contained in a new Schedule 2A inserted in the 1986 Regulations by the 1996 Regulations) in relation to vehicles for which a Minister’s approval certificate has been issued by virtue of the Approval Regulations.
