The M6 Birmingham To Carlisle Motorway (at Haighton) Special Roads Scheme 1997 Transfer Order 1997

The Secretary of State for Transport makes this order in exercise of powers conferred by section 18 of the Highways Act 1980 and of all other powers enabling him in that behalf:—

1.  The connecting roads shall be transferred to the Secretary of State for Transport. This transfer shall take effect as from the date on which the Secretary of State is notified by Lancashire County Council that the connecting roads have been completed and are open to traffic.

2.  Immediately after the transfer of the connecting roads, they shall be classified as special roads.

3.  In this order:—

(1) all measurements of distance are measured along the route of the relevant highway;

(i)“the connecting roads” means the special roads to be provided by the Secretary of State in pursuance of “The M6 Motorway (at Haighton) Connecting Roads Scheme 1997.”

(ii)“special roads” means the special roads to be provided in pursuance of “The Lancashire County Council (Proposed Connecting Roads to M6 Motorway at Haighton) Special Roads Scheme 1992 Confirmation Instrument 1993 ”, signed by authority of the Secretary of State and deposited at the Department of Transport, Romney House, Marsham Street, London, SW1P 3PY.

4.  This order shall come into operation on 8th May 1997 and may be cited as the M6 Birmingham to Carlisle Motorway (at Haighton) Special Roads Scheme 1997. Transfer Order 1997.
