The East Surrey and Sutton District Water (Amendment of Local Enactments Etc.) Order 1996

Whereas provision is made in relation to East Surrey Water plc (“East Surrey”) and The Sutton District Water Plc (“Sutton”) in local statutory provisions;

And whereas with effect from 1st April 1996 the Director General of Water Services has made a variation under section 8 of the Water Industry Act 19911 replacing Sutton as a water undertaker;

And whereas by virtue of that variation East Surrey will hold an appointment as the water undertaker for the whole of the area for which East Surrey and Sutton each hold appointments as water undertakers;

And whereas with effect from 1st April 1996 Sutton will transfer properties, rights and liabilities to East Surrey by a transfer scheme under Schedule 2 to the Water Industry Act 1991;

And whereas it appears to the Secretary of State appropriate for the purposes of the above-mentioned variation and transfer scheme that provision be made corresponding to provisions originally made by Schedule 26 to the Water Act 19892 and that local statutory provisions relating to East Surrey and Sutton be amended or repealed;

Now therefore the Secretary of State, in exercise of the powers conferred on him by paragraph 7 of Schedule 2 to the Water Industry Act 1991, hereby makes the following Order:

Citation, commencement and interpretation1

This Order may by cited as the East Surrey and Sutton District Water (Amendment of Local Enactments Etc.) Order 1996 and shall come into force on 1st April 1996.

In this Order—

“East Surrey” means East Surrey Water Plc; and
“Sutton” means The Sutton District Water Plc.

Amendment of references in local statutory provisions etc.2

Any reference to Sutton, or to the undertaking of Sutton, in any local statutory provision and in any charges scheme made by Sutton under section 76 of the Water Act 1989 or section 143 of the Water Industry Act 1991 shall have effect, subject to paragraph (2), as a reference to East Surrey or, as the case may be, to the undertaking of East Surrey.

Paragraph (1) shall only apply to any local statutory provisions or charges scheme in relation to the area, things or persons in relation to which or whom that provision or scheme has effect before 1st April 1996.

Repeal of local provisions3

Section 9 of the East Surrey Water Act 19213 is repealed.
